A BILL TO BE ENTITLED
AN ACT
relating to the use of certain terms to describe benefits for dental
care services.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter E, Chapter 1451, Insurance Code, is
amended by adding Section 1451.208 to read as follows:
       Sec. 1451.208.  USE OF CERTAIN TERMS AUTHORIZED. An
employee benefit plan or a health insurance policy may use any of
the following terms, or analogous terms, to describe that the plan
or policy provides payment or reimbursement for services provided
by contracting provider dentists and noncontracting provider
dentists:
             (1)  preferred provider arrangement;
             (2)  preferred provider organization;
             (3)  network arrangement;
             (4)  in-network services;
             (5)  out-of-network services; and
             (6)  participating provider organization.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
