A BILL TO BE ENTITLED
AN ACT
relating to public disclosure of student referrals for services
made by counselors in public schools.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 33.006, Education Code, is amended by
adding Subsection (d) to read as follows:
       (d)  This subsection applies only to a school district that,
during the preceding school year, made at least 20 total referrals
under Subsection (b)(2) at the middle school, junior high school,
and high school levels.  In order to provide public disclosure of
the types of referrals made under Subsection (b)(2), each school
district to which this subsection applies shall include in the
performance report required by Section 39.053 a list of each
agency, organization, or other entity to which one or more district
students in middle school, junior high school, or high school was
referred by a counselor for services during the preceding school
year and the number of times that a referral was made to each listed
agency, organization, or other entity. A school district shall
provide the information required by this subsection in a manner
that does not identify the specific students involved.
       SECTION 2.  Section 33.006(d), Education Code, as added by
this Act, applies beginning with the performance report required to
be published under Section 39.053, Education Code, for the
2007-2008 school year.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
