A BILL TO BE ENTITLED
AN ACT
relating to the authority of certain municipalities that elect the
members of the municipal governing body wholly or partly from
single-member districts.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 275, Election Code, is amended by adding
Section 275.004 to read as follows:
       Sec. 275.004. ELECTION FROM SINGLE-MEMBER DISTRICTS REQUIRED
FOR CERTAIN ACTIONS. An area that is located in a special district
and that must be included in a municipality's annexation plan as a
prerequisite to annexation may not be annexed by a municipality
with a population of more than 650,000 unless at the time the area
is included in the municipality's annexation plan:
             (1)  the municipality elects the members of its
governing body wholly or partly from single-member districts;
             (2)  the municipality provides in the annexation plan
for the new boundaries of the single-member districts that will be
used to elect the members of the municipal governing body following
the annexation of the area located in the special district; and
             (3)  under the boundaries proposed under Subdivision
(2), the area located in the special district is included entirely
within one single-member district.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
