A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of certain municipalities that elect the |
|
|
members of the municipal governing body wholly or partly from |
|
|
single-member districts. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 275, Election Code, is amended by adding |
|
|
Section 275.004 to read as follows: |
|
|
Sec. 275.004. ELECTION FROM SINGLE-MEMBER DISTRICTS REQUIRED |
|
|
FOR CERTAIN ACTIONS. An area that is located in a special district |
|
|
and that must be included in a municipality's annexation plan as a |
|
|
prerequisite to annexation may not be annexed by a municipality |
|
|
with a population of more than 650,000 unless at the time the area |
|
|
is included in the municipality's annexation plan: |
|
|
(1) the municipality elects the members of its |
|
|
governing body wholly or partly from single-member districts; |
|
|
(2) the municipality provides in the annexation plan |
|
|
for the new boundaries of the single-member districts that will be |
|
|
used to elect the members of the municipal governing body following |
|
|
the annexation of the area located in the special district; and |
|
|
(3) under the boundaries proposed under Subdivision |
|
|
(2), the area located in the special district is included entirely |
|
|
within one single-member district. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
