A BILL TO BE ENTITLED
AN ACT
relating to the use of grant money received from the criminal
justice division of the governor's office.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 772.006, Government Code, is amended by
adding Subsections (d), (e), and (f) to read as follows:
       (d)  A grant awarded under 42 U.S.C. Section 3751 and
allocated to a law enforcement agency, drug task force, or other
entity under this section must be used strictly for a purpose
authorized by 42 U.S.C. Section 3751.
       (e)  A grant awarded under 42 U.S.C. Section 3751 or from a
state or federal homeland security funding source, including state
general revenue funds appropriated for purposes of homeland
security, may be used to provide additional personnel, equipment,
supplies, contractual support, training, technical assistance, or
information systems to a law enforcement or other program
established to reduce crime related to drugs or terrorism, violent
or organized crime, or official corruption occurring in one or more
counties adjacent to the international border of this state. The
division shall prioritize the allocation of the grant money for the
border law enforcement purposes described by this subsection.
       (f)  The criminal justice division may award a grant under
this section to a law enforcement agency, drug task force, or other
entity for use by the entity in reducing crime related to drugs or
terrorism, violent or organized crime, or official corruption
occurring in one or more counties adjacent to the international
border of this state. The division may contract with the grant
recipient to ensure that the grant will be used for the purposes
described by this subsection. The contract must require:
             (1)  the border law enforcement operations of the grant
recipient to be under the command and control of the director of the
Department of Public Safety; and
             (2)  a grant recipient to report to the Department of
Public Safety, in accordance with the rules of that department,
information regarding the effectiveness of the grant recipient's
border law enforcement operations in achieving the purposes
described by this subsection.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
