A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the use of grant money received from the criminal |
|
justice division of the governor's office. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 772.006, Government Code, is amended by |
|
adding Subsections (d) and (e) to read as follows: |
|
(d) A grant awarded under 42 U.S.C. Section 3751 and |
|
allocated to a law enforcement agency, drug task force, or other |
|
entity under this section must be used strictly for a purpose |
|
authorized by 42 U.S.C. Section 3751, including the provision of |
|
additional personnel, equipment, supplies, contractual support, |
|
training, technical assistance, or information systems to a law |
|
enforcement or other program established to reduce crime related to |
|
drugs or terrorism, violent or organized crime, or official |
|
corruption occurring in one or more counties adjacent to the |
|
international border of this state. The division shall prioritize |
|
the allocation of the federal grant money for the border law |
|
enforcement purposes described by this subsection. |
|
(e) The criminal justice division may award a grant under |
|
this section to a law enforcement agency, drug task force, or other |
|
entity for use by the entity in reducing crime related to drugs or |
|
terrorism, violent or organized crime, or official corruption |
|
occurring in one or more counties adjacent to the international |
|
border of this state. The division may contract with the grant |
|
recipient to ensure that the grant will be used for the purposes |
|
described by this subsection. The contract must require: |
|
(1) the border law enforcement operations of the grant |
|
recipient to be under the command and control of the director of the |
|
Department of Public Safety; and |
|
(2) a grant recipient to report to the Department of |
|
Public Safety, in accordance with the rules of that department, |
|
information regarding the effectiveness of the grant recipient's |
|
border law enforcement operations in achieving the purposes |
|
described by this subsection. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
