A BILL TO BE ENTITLED
AN ACT
relating to compensation of Texas Department of Transportation
employees for certain compensatory time.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter F, Chapter 201, Transportation Code,
is amended by adding Section 201.407 to read as follows:
       Sec. 201.407.  PAYMENT FOR COMPENSATORY TIME. (a)
Notwithstanding any other law, the department may compensate
employees of the department, whether subject to or exempt from the
overtime provisions of the federal Fair Labor Standards Act of 1938
(29 U.S.C. Section 201 et seq.), for compensatory time earned when
taking compensatory time off would be disruptive to the
department's normal business functions.
       (b)  The rate of compensation authorized under this section
is equal to the employee's regular rate of pay.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
