A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a late fee charged in connection with the inspection of |
|
a vehicle with an invalid inspection certificate. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter H, Chapter 548, Transportation Code, |
|
is amended by adding Section 548.509 to read as follows: |
|
Sec. 548.509. LATE INSPECTION FEE. (a) In addition to any |
|
other inspection fee provided by this subchapter, for each 30-day |
|
period or part of a 30-day period following the date an inspection |
|
certificate displayed on a vehicle ceases to be valid, a late |
|
inspection fee in an amount equal to 1/12 of the fee provided for |
|
the certificate shall be assessed and collected. If the vehicle |
|
does not display an expired inspection certificate, the amount of |
|
the fee under this subsection is equal to the fee provided by this |
|
subchapter for the certificate that is subsequently attached to or |
|
produced for the vehicle. |
|
(b) In addition to the fee provided by Subsection (a), the |
|
person conducting the inspection shall assess and may retain an |
|
administrative fee for assessing and collecting the fee under that |
|
subsection in an amount equal to 50 percent of the fee collected |
|
under that subsection, or $3, whichever is greater. |
|
(c) Each fee collected under Subsection (a) shall be sent to |
|
the department. Notwithstanding Section 548.508, the department |
|
shall send each fee it receives under this subsection to the |
|
comptroller for deposit to the credit of the clean air account. |
|
SECTION 2. Section 382.0622(a), Health and Safety Code, is |
|
amended to read as follows: |
|
(a) Clean Air Act fees consist of: |
|
(1) fees collected by the commission under Sections |
|
382.062, 382.0621, 382.202, and 382.302 and as otherwise provided |
|
by law; [and] |
|
(2) $2 of each advance payment collected by the |
|
Department of Public Safety for inspection certificates for |
|
vehicles other than mopeds under Section 548.501, Transportation |
|
Code; and |
|
(3) each fee received by the Department of Public |
|
Safety under Section 548.509, Transportation Code. |
|
SECTION 3. This Act takes effect September 1, 2007. |
