A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to emergency appropriations for costs associated with the |
|
special constitutional amendment election. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. REIMBURSEMENT TO COUNTIES FOR COSTS OF SPECIAL |
|
ELECTION. In addition to the amounts previously appropriated for |
|
the state fiscal biennium ending August 31, 2007, the amount of $15 |
|
million is appropriated out of the general revenue fund to the |
|
Secretary of State for the purpose of reimbursing each county in |
|
this state for the expenses incurred in conducting a special |
|
state-mandated election to be held on May 12, 2007, on the |
|
constitutional amendment authorizing the legislature to adjust the |
|
school property tax limitation on the residence homesteads of |
|
persons who are 65-years-old and older or disabled. In the event |
|
the actual costs exceed the amount appropriated herein, the |
|
Secretary of State shall request that the Legislative Budget Board |
|
and the Governor fulfill the state's financial obligation to the |
|
counties through budget execution authority under Chapter 317, |
|
Government Code. |

SECTION 2. EFFECTIVE DATE. This Act takes effect |
|
immediately if it receives a vote of two-thirds of all the members |
|
elected to each house, as provided by Section 39, Article III, Texas |
|
Constitution. If this Act does not receive the vote necessary for |
|
immediate effect, this Act takes effect on the 91st day after the |
|
last day of the legislative session. |
