A BILL TO BE ENTITLED
AN ACT
relating to emergency appropriations for costs associated with the
special constitutional amendment election.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  REIMBURSEMENT TO COUNTIES FOR COSTS OF SPECIAL
ELECTION.  In addition to the amounts previously appropriated for
the state fiscal biennium ending August 31, 2007, the amount of $15
million is appropriated out of the general revenue fund to the
Secretary of State for the purpose of reimbursing each county in
this state for the expenses incurred in conducting a special
state-mandated election to be held on May 12, 2007, on the
constitutional amendment authorizing the legislature to adjust the
school property tax limitation on the residence homesteads of
persons who are 65-years-old and older or disabled.  In the event
the actual costs exceed the amount appropriated herein, the
Secretary of State shall request that the Legislative Budget Board
and the Governor fulfill the state's financial obligation to the
counties through budget execution authority under Chapter 317,
Government Code.
       SECTION 2.  EFFECTIVE DATE.  This Act takes effect
immediately if it receives a vote of two-thirds of all the members
elected to each house, as provided by Section 39, Article III, Texas
Constitution.  If this Act does not receive the vote necessary for
immediate effect, this Act takes effect on the 91st day after the
last day of the legislative session.
