A BILL TO BE ENTITLED
AN ACT
relating to the authority of a private business to provide security
services.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter H, Chapter 1702, Occupations Code, is
amended by adding Section 1702.184 to read as follows:
       Sec. 1702.184.  PROVISION OF SECURITY SERVICES BY PRIVATE
BUSINESS. (a) A private business may provide security services to
buildings and grounds located on the private business's property.
       (b)  A private business providing security under this
section may not be:
             (1)  prohibited from contracting with a commissioned
security officer or a security services contractor to provide the
security service; or
             (2)  required to contract with a peace officer to
provide the security services.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
