A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the availability under the public information law of |
|
|
certain documents filed with a county clerk or a district clerk. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 552.117(b), Government Code, is amended |
|
|
to read as follows: |
|
|
(b) All documents filed with a county clerk and all |
|
|
documents filed with a district clerk are exempt from this section |
|
|
if: |
|
|
(1) the documents are not available on the Internet to |
|
|
the general public; or |
|
|
(2) before giving access to a document or providing a |
|
|
copy of a document, the county clerk or district clerk obtains and |
|
|
makes a permanent record of the name, address, and date of birth of |
|
|
the person requesting the document. |
|
|
SECTION 2. Section 552.1175(e), Government Code, is amended |
|
|
to read as follows: |
|
|
(e) All documents filed with a county clerk and all |
|
|
documents filed with a district clerk are exempt from this section |
|
|
if: |
|
|
(1) the documents are not available on the Internet to |
|
|
the general public; or |
|
|
(2) before giving access to a document or providing a |
|
|
copy of a document, the county clerk or district clerk obtains and |
|
|
makes a permanent record of the name, address, and date of birth of |
|
|
the person requesting the document. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
