A BILL TO BE ENTITLED
AN ACT
relating to certain requirements for the issuance and renewal of a
salvage vehicle dealer license.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 2302.104, Occupations Code, is amended
by adding Subsections (d) and (e) to read as follows:
       (d)  In addition to the other requirements for issuance of a
license, an applicant who is classified as a used vehicle parts
dealer, salvage vehicle broker, or salvage vehicle rebuilder must
provide proof satisfactory to the department that the applicant
holds a current storm water permit issued by the Texas Commission on
Environmental Quality.
       (e)  The department shall issue a temporary license to an
applicant who satisfies the requirements for a license other than
the requirement under Subsection (d).  A temporary license issued
under this subsection expires on the 120th day after the date of
issuance.  The department shall issue a license under this chapter
to an applicant who complies with Subsection (d) before the
expiration date of the temporary license.
       SECTION 2.  Subchapter D, Chapter 2302, Occupations Code, is
amended by adding Section 2302.154 to read as follows:
       Sec. 2302.154.  STORM WATER PERMIT REQUIRED FOR RENEWAL.  
(a)  In addition to the other requirements for renewal of a license,
a license holder who is classified as a used vehicle parts dealer,
salvage vehicle broker, or salvage vehicle rebuilder must provide
proof satisfactory to the department that the license holder holds
a current storm water permit issued by the Texas Commission on
Environmental Quality.
       (b)  The department shall issue a temporary license to an
applicant who satisfies the requirements for renewal of a license
other than the requirement under Subsection (a). A temporary
license issued under this subsection expires on the 120th day after
the date of issuance. The department shall renew the license of an
applicant who complies with Subsection (a) before the expiration
date of the temporary license.
       SECTION 3.  (a)  The change in law made by this Act by the
enactment of Section 2302.104(d), Occupations Code, applies to an
application for a license under Chapter 2302, Occupations Code,
that is filed on or after January 1, 2008. A license application
filed before that date is governed by the law in effect on the date
the application was filed, and the former law is continued in effect
for that purpose.
       (b)  The change in law made by this Act by the enactment of
Section 2302.154, Occupations Code, applies to the renewal of a
license that expires under Chapter 2302, Occupations Code, on or
after January 1, 2008. A license that expires before that date is
governed by the law in effect on the date the license expired, and
the former law is continued in effect for that purpose.
       (c)  The Texas Transportation Commission shall raise
application and renewal fees under Section 2302.052, Occupations
Code, as necessary to cover the costs of administering the changes
in law made by this Act.
       SECTION 4.  This Act takes effect September 1, 2007.
