AN ACT
|
|
relating to hearings regarding cease and desist orders against |
|
certain persons operating a career school or college without proper |
|
authority. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 132.301(a), Education Code, is amended |
|
to read as follows: |
|
(a) The commission may set a hearing on whether to issue a |
|
cease and desist order against a person under Section 132.303 if[:
|
|
[(1)] the commission has reason to believe that the |
|
person is operating a career school or college without a |
|
certificate issued by the commission in violation of Section |
|
132.151[; and
|
|
[(2)
the person has not responded to more than one
|
|
written notice from the commission regarding the person's
|
|
noncompliance with Section 132.151]. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
