A BILL TO BE ENTITLED
 
AN ACT
 
  relating to hearings regarding cease and desist orders against
  certain persons operating a career school or college without proper
  authority.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 132.301(a), Education Code, is amended
  to read as follows:
         (a)  The commission may set a hearing on whether to issue a
  cease and desist order against a person under Section 132.303 if[:
               [(1)]  the commission has reason to believe that the
  person is operating a career school or college without a
  certificate issued by the commission in violation of Section
  132.151[; and
               [(2)     the person has not responded to more than one
  written notice from the commission regarding the person's
  noncompliance with Section 132.151].
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2007.
