A BILL TO BE ENTITLED
AN ACT
relating to the electronic transmission of a federal postcard
application to vote by certain military personnel serving overseas.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 101.004(a), Election Code, is amended to
read as follows:
       (a)  Except as provided by Section 101.0041, a [A] federal
postcard application must be submitted by mailing it to the early
voting clerk for the election who serves the election precinct of
the applicant's residence.
       SECTION 2.  Chapter 101, Election Code, is amended by adding
Section 101.0041 to read as follows:
       Sec. 101.0041.  ELECTRONIC SUBMISSION OF APPLICATION. (a)
Instead of mailing the application as required by Section
101.004(a), an applicant may submit an electronic image of a
federal postcard application to the early voting clerk if the
applicant:
             (1)  is a member of the armed forces of the United
States who is on active duty overseas or the spouse or a dependent
of the member; and
             (2)  is submitting the application from an area:
                   (A)  in which members of the armed forces are
eligible to receive hostile fire pay or imminent danger pay; or
                   (B)  that has been designated by the president of
the United States as a combat zone.
       (b)  The secretary of state shall prescribe procedures as
necessary to implement this section.
       SECTION 3.  This Act takes effect September 1, 2007.
