A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to exclusion of performance data of chronically absent |
|
|
students under the public school accountability system. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.051, Education Code, is amended by |
|
|
adding Subsection (h) to read as follows: |
|
|
(h) Notwithstanding any other provision of this chapter, |
|
|
the commissioner shall by rule provide that the performance of a |
|
|
student on an assessment instrument required by Section 39.023(a), |
|
|
(c), or (l) during a school year is not included in determining the |
|
|
performance of a school district or campus under the indicator |
|
|
required by Subsection (b)(1) for that school year if the student |
|
|
does not attend school for at least 90 percent of the days that |
|
|
classes are offered during that school year. |
|
|
SECTION 2. This Act applies beginning with the 2007-2008 |
|
|
school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
