A BILL TO BE ENTITLED
AN ACT
relating to exclusion of performance data of chronically absent
students under the public school accountability system.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 39.051, Education Code, is amended by
adding Subsection (h) to read as follows:
       (h)  Notwithstanding any other provision of this chapter,
the commissioner shall by rule provide that the performance of a
student on an assessment instrument required by Section 39.023(a),
(c), or (l) during a school year is not included in determining the
performance of a school district or campus under the indicator
required by Subsection (b)(1) for that school year if the student
does not attend school for at least 90 percent of the days that
classes are offered during that school year.
       SECTION 2.  This Act applies beginning with the 2007-2008
school year.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
