A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the responsibility for and management of the fuel
  ethanol and biodiesel production incentive program.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  (a)  The responsibility for and management of the
  fuel ethanol and biodiesel production incentive program under
  Chapter 16, Agriculture Code, is transferred from the Texas
  Economic Development and Tourism Office to the Department of
  Agriculture.
         (b)  Any assets, duties, functions, and funding for the
  program, including money in the fuel ethanol and biodiesel
  production account, are transferred on the effective date of this
  Act to the Department of Agriculture.
         (c)  A rule of the Texas Economic Development and Tourism
  Office related to the fuel ethanol and biodiesel production
  incentive program continues in effect until changed by the
  Department of Agriculture.
         (d)  A reference in law to "office" in Chapter 16,
  Agriculture Code, is a reference to the Department of Agriculture.
         SECTION 2.  This Act takes effect September 1, 2007.
