A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to disbursement of certain penalties assessed against |
|
|
alcoholic beverage permit and license holders. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 5, Alcoholic Beverage |
|
|
Code, is amended by adding Section 5.65 to read as follows: |
|
|
Sec. 5.65. DISBURSEMENT OF CERTAIN CIVIL PENALTIES. If the |
|
|
commission assesses a civil penalty under this code in an action |
|
|
that is based on an investigation conducted by a local law |
|
|
enforcement agency, the commission shall disburse the penalty to |
|
|
the law enforcement agency that conducted the investigation. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a penalty assessed on or after the effective date of this Act. A |
|
|
penalty assessed before that date is governed by the law in effect |
|
|
immediately before that date, and that law is continued in effect |
|
|
for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
