A BILL TO BE ENTITLED
AN ACT
relating to eligibility to serve as a member of the board of
trustees of certain public retirement systems of this state.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 815.0031, Government Code, is amended by
amending Subsection (e) and adding Subsection (f) to read as
follows:
       (e)  A person may not [serve as a trustee or] act as the
general counsel to the board if the person is required to register
as a lobbyist under Chapter 305 because of the person's activities
for compensation on behalf of a business or an association related
to the operation of the board.
       (f)  A person may not serve as a trustee if the person is
required to register as a lobbyist under Chapter 305.
       SECTION 2.  Section 825.0032, Government Code, is amended by
amending Subsection (f) and adding Subsection (g) to read as
follows:
       (f)  A person may not [serve as a trustee or] act as the
general counsel to the board or the retirement system if the person
is required to register as a lobbyist under Chapter 305 because of
the person's activities for compensation on behalf of a business or
an association related to the operation of the board.
       (g)  A person may not serve as a trustee if the person is
required to register as a lobbyist under Chapter 305.
       SECTION 3.  Section 845.003, Government Code, is amended by
adding Subsection (d) to read as follows:
       (d)  A person is not eligible to serve as a trustee if the
person is required to register as a lobbyist under Chapter 305.
       SECTION 4.  Section 855.003, Government Code, is amended by
adding Subsection (e) to read as follows:
       (e)  A person is not eligible to serve as a trustee if the
person is required to register as a lobbyist under Chapter 305.
       SECTION 5.  The changes in law made by this Act apply to a
member of the board of trustees of a public retirement system of
this state who is serving on the board on the effective date of this
Act or is elected or appointed to the board for a term that begins on
or after the effective date of this Act.
       SECTION 6.  This Act takes effect September 1, 2007.
