A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to eligibility to serve as a member of the board of |
|
|
trustees of certain public retirement systems of this state. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 815.0031, Government Code, is amended by |
|
|
amending Subsection (e) and adding Subsection (f) to read as |
|
|
follows: |
|
|
(e) A person may not [serve as a trustee or] act as the |
|
|
general counsel to the board if the person is required to register |
|
|
as a lobbyist under Chapter 305 because of the person's activities |
|
|
for compensation on behalf of a business or an association related |
|
|
to the operation of the board. |
|
|
(f) A person may not serve as a trustee if the person is |
|
|
required to register as a lobbyist under Chapter 305. |
|
|
SECTION 2. Section 825.0032, Government Code, is amended by |
|
|
amending Subsection (f) and adding Subsection (g) to read as |
|
|
follows: |
|
|
(f) A person may not [serve as a trustee or] act as the |
|
|
general counsel to the board or the retirement system if the person |
|
|
is required to register as a lobbyist under Chapter 305 because of |
|
|
the person's activities for compensation on behalf of a business or |
|
|
an association related to the operation of the board. |
|
|
(g) A person may not serve as a trustee if the person is |
|
|
required to register as a lobbyist under Chapter 305. |
|
|
SECTION 3. Section 845.003, Government Code, is amended by |
|
|
adding Subsection (d) to read as follows: |
|
|
(d) A person is not eligible to serve as a trustee if the |
|
|
person is required to register as a lobbyist under Chapter 305. |
|
|
SECTION 4. Section 855.003, Government Code, is amended by |
|
|
adding Subsection (e) to read as follows: |
|
|
(e) A person is not eligible to serve as a trustee if the |
|
|
person is required to register as a lobbyist under Chapter 305. |
|
|
SECTION 5. The changes in law made by this Act apply to a |
|
|
member of the board of trustees of a public retirement system of |
|
|
this state who is serving on the board on the effective date of this |
|
|
Act or is elected or appointed to the board for a term that begins on |
|
|
or after the effective date of this Act. |
|
|
SECTION 6. This Act takes effect September 1, 2007. |
