A BILL TO BE ENTITLED
AN ACT
relating to testing employees of state schools for illegal drug
use.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 553, Health and Safety
Code, is amended by adding Section 553.002 to read as follows:
       Sec. 553.002.  ILLEGAL DRUG POLICY FOR STATE SCHOOL
EMPLOYEES. (a)  The superintendent of each state school shall adopt
and enforce a policy to prohibit the use of illegal drugs by state
school employees.
       (b)  The superintendent of each state school shall enforce
the policy adopted under Subsection (a) by mandatory testing of
every state school employee at least once each year.
       (c)  The policy adopted under Subsection (a) shall provide
for the termination of an employee who tests positively for an
illegal drug. The policy may provide for not more than two
probationary periods of not more than six months each before an
employee is terminated following a positive test for an illegal
drug.
       SECTION 2.  This Act takes effect September 1, 2007.
