A BILL TO BE ENTITLED

AN ACT
|

relating to testing employees of state schools for illegal drug |
|
use. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 553, Health and Safety |
|
Code, is amended by adding Section 553.002 to read as follows: |
|
Sec. 553.002. ILLEGAL DRUG POLICY FOR STATE SCHOOL |
|
EMPLOYEES. (a) The superintendent of each state school shall adopt |
|
and enforce a policy to prohibit the use of illegal drugs by state |
|
school employees. |
|
(b) The superintendent of each state school shall enforce |
|
the policy adopted under Subsection (a) by mandatory testing of |
|
every state school employee at least once each year. |
|
(c) The policy adopted under Subsection (a) shall provide |
|
for the termination of an employee who tests positively for an |
|
illegal drug. The policy may provide for not more than two |
|
probationary periods of not more than six months each before an |
|
employee is terminated following a positive test for an illegal |
|
drug. |
|
SECTION 2. This Act takes effect September 1, 2007. |
