A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the counting of a provisional ballot cast by a voter in |
|
|
a precinct in which the voter does not reside. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 65.054, Election Code, is amended by |
|
|
adding Subsection (e) to read as follows: |
|
|
(e) For a provisional ballot cast outside the precinct in |
|
|
which a voter resides, if the voter was a person registered to vote |
|
|
in this state the board shall accept the ballot but only count a |
|
|
vote cast for: |
|
|
(1) an office or proposition stating a measure for |
|
|
which a statewide election was held; and |
|
|
(2) an office or proposition stating a measure in a |
|
|
territorial unit of which the person was a resident at the time of |
|
|
the election. |
|
|
SECTION 2. This Act takes effect September 1, 2007. |
