A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the penalty for certain violations of county traffic |
|
|
regulations. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Sections 251.161(b) and (c), Transportation |
|
|
Code, are amended to read as follows: |
|
|
(b) An [Except as provided by Subsections (c) and (d), an] |
|
|
offense under this section is punishable by a fine not to exceed |
|
|
$200 [$50]. |
|
|
(c) If conduct that constitutes an offense under this section |
|
|
also constitutes an offense under any other law, the actor may be |
|
|
prosecuted under this section or the other law. [If it is shown on
|
|
|
the trial of an offense under this section that the person has
|
|
|
previously been convicted one time of the offense, the offense is
|
|
|
punishable by a fine not to exceed $200.] |
|
|
SECTION 2. Section 251.161(d) is repealed. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
