A BILL TO BE ENTITLED
AN ACT
relating to the imposition of sanctions by the commissioner of
education on certain school districts that fail to comply with
certain commitments and covenants.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter C, Chapter 7, Education Code, is
amended by adding Section 7.061 to read as follows:
       Sec. 7.061.  AUTHORITY OF COMMISSIONER TO SANCTION CERTAIN
SCHOOL DISTRICTS. (a) This section applies only to a school
district that:
             (1)  has a student enrollment of at least 150,000;
             (2)  is located in a county with a population of at
least two million; and
             (3)  has adopted a declaration of commitments and
covenants on release from supervision of a United States district
court by a final court order.
       (b)  The commissioner may impose a sanction, including a
monetary sanction, on a school district if the commissioner
determines the district is not in compliance with the declaration
described by Subsection (a)(3).
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
