A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to an air permits database created and maintained by the |
|
|
Texas Commission on Environmental Quality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 382, Health and Safety |
|
|
Code, is amended by adding Section 382.005 to read as follows: |
|
|
Sec. 382.005. ELECTRONIC AIR PERMITS DATABASE. The |
|
|
commission shall establish an electronic database accessible to |
|
|
commission inspectors and other staff to assist the inspectors and |
|
|
staff in determining the pollution limits that apply at each |
|
|
facility. |
|
|
SECTION 2. Section 382.062, Health and Safety Code, is |
|
|
amended by adding Subsection (f) to read as follows: |
|
|
(f) For each fee charged under this section, the commission |
|
|
shall charge the applicant for the permit, permit amendment, permit |
|
|
renewal, or inspection an additional 4.03 percent of the fee |
|
|
otherwise charged. Money collected under this subsection may be |
|
|
appropriated only to the commission and only to establish and |
|
|
maintain the electronic air permits database under Section 382.005. |
|
|
SECTION 3. Section 382.062(f), Health and Safety Code, as |
|
|
added by this Act, applies only to: |
|
|
(1) an application for a permit, permit amendment, or |
|
|
permit renewal filed on or after the effective date of this Act; and |
|
|
(2) an inspection conducted on or after the effective |
|
|
date of this Act. |

|
SECTION 4. This Act takes effect September 1, 2007. |
