A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to claims cost reporting requirements for issuers of |
|
|
state-regulated group health benefit plans. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1209.001, Chapter 1209, Insurance Code, |
|
|
is amended to read as follows: |
|
|
This chapter applies only to a group health benefit plan, |
|
|
including a small or large employer health benefit plan written |
|
|
under Chapter 1501, that: |
|
|
SECTION 2. Section 1209.002, Chapter 1209, Insurance Code |
|
|
is amended by adding Subsections (c), (d), and (e) to read as |
|
|
follows: |
|
|
(c) A plan issuer shall provide information requested by an |
|
|
employer under this section annually not later than the 30th day |
|
|
before the anniversary or renewal date of the employer's health |
|
|
benefit plan. |
|
|
(d) Notwithstanding Subsection (c), a plan issuer is not |
|
|
required to provide information requested by an employer under this |
|
|
section earlier than the 30th day after the date of the initial |
|
|
request. |
|
|
(e) A plan issuer may not provide any information required |
|
|
under this section if federal law prohibits the release of the |
|
|
information. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
