A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Texas Department of Transportation |
|
|
to enter real property for a toll project. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 203.068, Transportation Code, is amended |
|
|
by adding Subsection (d) to read as follows: |
|
|
(d) The department and its authorized agents shall: |
|
|
(1) provide notice of an entry under Subsection (a) to |
|
|
the owner of the real property, water, or premises not less than 14 |
|
|
days before the date of entry; and |
|
|
(2) make every reasonable effort to coordinate an |
|
|
entry under Subsection (a) with the owner of the real property, |
|
|
water, or premises. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
