A BILL TO BE ENTITLED
 
AN ACT
  relating to state facility management and maintenance practices.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 2165.052, Government Code, is amended to
  read as follows:
         Sec. 2165.052.  REPAIR AND IMPROVEMENT OF STATE
  BUILDINGS.  (a)  On direction of the commission's attention to a
  needed improvement or repair of a building or office by the head of
  a department or office, the commission shall provide for and direct
  the repair or improvement.
         (b)  The commission shall establish a preventive maintenance
  program and enter into energy savings performance contracts of the
  type described by Section 2166.406(a) covering each state building
  or office for which the commission is responsible for providing
  facility management services under this chapter or other law.
         SECTION 2.  Section 2165.057(a), Government Code, is amended
  to read as follows:
         (a)  The commission shall:
               (1)  develop and implement policies that clearly define
  the responsibilities of the commission and the commission's staff
  that relate to conducting facilities management services for state
  agency facilities under Section 2165.007;
               (2)  with each state agency tenant, enter into a
  contract that describes the specific level of facilities management
  services the commission will provide and any activities related to
  facilities management services the tenant agency and its employees
  will provide at agency cost; and
               (3)  establish property-specific budgets for each
  state agency facility for which the commission provides facilities
  management services to assist in contracting under Subdivision (2)
  and in evaluating the success and efficiency of the facilities
  management services provided by the commission.
         SECTION 3.  This Act takes effect September 1, 2007.
