A BILL TO BE ENTITLED
AN ACT
relating to the preservation, maintenance, and restoration of
certain state buildings by the State Preservation Board.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 442.0071(e), Government Code, is amended
to read as follows:
       (e)  The State Preservation Board [Purchasing and General
Services Commission] and the office of the governor may exercise
the powers and shall perform the duties relating to the Governor's
Mansion that are provided by applicable law, subject to the
requirements of this section.
       SECTION 2. Chapter 443, Government Code, is amended by
adding Section 443.0073 to read as follows:
       Sec. 443.0073.  PRESERVATION AND MAINTENANCE OF CERTAIN
STATE BUILDINGS.  (a)  The board shall preserve, maintain, and
restore the Governor's Mansion, the Gethsemane Church and Luther
Hall, the Elrose Building, the Christianson-Leberman Building, and
the Carrington-Covert House, their contents, and their grounds,
subject to the Texas Historical Commission's duties to preserve,
maintain, and restore the buildings and grounds under other law.
       (b)  For purposes of this section, the Gethsemane Church and
the Carrington-Covert House are the buildings described by Section
442.0072(c), and Luther Hall and the Elrose Building are located on
16th Street between Colorado Street and North Congress Avenue in
Austin and the Christianson-Leberman Building is located at 1304
Colorado Street in Austin.
       SECTION 3.  Section 2165.007(b), Government Code, is amended
to read as follows:
       (b)  Notwithstanding any other law, the commission shall
provide facilities management services in relation to all state
agency facilities in Travis County or a county adjacent to Travis
County. The commission's duty does not apply to:
             (1)  a facility owned or operated by an institution of
higher education;
             (2)  military facilities;
             (3)  facilities owned or operated by the Texas
Department of Criminal Justice;
             (4)  facilities owned or operated by the Texas Youth
Commission;
             (5)  facilities owned or operated by the Texas
Department of Transportation;
             (6)  the Capitol, including the Capitol Extension, the
General Land Office building, the Bob Bullock Texas State History
Museum, [and] any museum located on the Capitol grounds, and any
property maintained by the State Preservation Board under Section
443.0073;
             (7)  a facility determined by the commission to be
completely residential;
             (8)  a regional or field office of a state agency; or
             (9)  a facility located within or on state park
property.
       SECTION 4.  This Act takes effect September 1, 2007.
