A BILL TO BE ENTITLED
AN ACT
relating to the regulation of signs along interstate and primary
highways.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 391.005, Transportation Code, is amended
to read as follows:
       Sec. 391.005.  EXEMPTION. (a) This chapter does not apply
to a sign erected solely for and relating to a public election if
the sign:
             (1)  is on private property;
             (2)  is erected not earlier than the 90th day before the
date of the election and is removed not later than the 10th day
after the election date;
             (3)  is constructed of lightweight material; and
             (4)  has a surface area not larger than 50 square feet.
       (b)  This chapter does not apply to a sign that:
             (1)  provides notice of a meeting of a nonprofit
service club or charitable organization, or a religious service;
and
             (2)  has a surface area not larger than 18 square feet.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
