A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the regulation of signs along interstate and primary |
|
|
highways. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 391.005, Transportation Code, is amended |
|
|
to read as follows: |
|
|
Sec. 391.005. EXEMPTION. (a) This chapter does not apply |
|
|
to a sign erected solely for and relating to a public election if |
|
|
the sign: |
|
|
(1) is on private property; |
|
|
(2) is erected not earlier than the 90th day before the |
|
|
date of the election and is removed not later than the 10th day |
|
|
after the election date; |
|
|
(3) is constructed of lightweight material; and |
|
|
(4) has a surface area not larger than 50 square feet. |
|
|
(b) This chapter does not apply to a sign that: |
|
|
(1) provides notice of a meeting of a nonprofit |
|
|
service club or charitable organization, or a religious service; |
|
|
and |
|
|
(2) has a surface area not larger than 18 square feet. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
