A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the requirement to be licensed as a sex offender |
|
treatment provider. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 110.001(7), Occupations Code, is amended |
|
to read as follows: |
|
(7) "Sex offender treatment provider" means a |
|
person[,] licensed under this chapter to provide [or certified to
|
|
practice in this state, including a physician, psychiatrist,
|
|
psychologist, licensed professional counselor, licensed marriage
|
|
and family therapist, or social worker, who provides] mental health |
|
or medical services for rehabilitation of sex offenders. |
|
SECTION 2. Subchapter A, Chapter 110, Occupations Code, is |
|
amended by adding Section 110.002 to read as follows: |
|
Sec. 110.002. EXEMPTIONS. This chapter does not apply to: |
|
(1) a physician licensed under Subtitle B who is |
|
engaged strictly in the practice of medicine; |
|
(2) a nurse licensed under Chapter 301 who is engaged |
|
strictly in the practice of professional nursing; |
|
(3) a psychologist licensed under Chapter 501 who is |
|
engaged strictly in the practice of psychology; |
|
(4) a licensed marriage and family therapist under |
|
Chapter 502 who is engaged strictly in the practice of marriage and |
|
family therapy; |
|
(5) a licensed professional counselor under Chapter |
|
503 who is engaged strictly in the practice of professional |
|
counseling; or |
|
(6) a licensed social worker under Chapter 505 who is |
|
engaged strictly in the practice of social work. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
