A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the qualifications for directors of municipal utility |
|
|
districts. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 54.102, Water Code, is amended to read as |
|
|
follows: |
|
|
Sec. 54.102. QUALIFICATIONS FOR DIRECTORS. (a) Except as |
|
|
provided by Subsection (b), to [To] be qualified to serve as a |
|
|
director, a person must meet the eligibility requirements of |
|
|
Section 141.001(a), Election Code. |
|
|
(b) A director of a district that, on the date on which the |
|
|
director is elected to the board, has been holding director |
|
|
elections for less than five years, shall be at least 18 years old, |
|
|
a resident citizen of the State of Texas, and either own land |
|
|
subject to taxation in the district or be a qualified voter within |
|
|
the district. Section 141.001(a), Election Code, does not apply to |
|
|
a director described by this subsection. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a member of the board of directors of a municipal utility |
|
|
district elected on or after the effective date of this Act. A |
|
|
member of the board of directors elected before the effective date |
|
|
of this Act is covered by the law in effect on the date the member |
|
|
was elected, and the former law is continued in effect for that |
|
|
purpose. |

|
SECTION 3. This Act takes effect September 1, 2007. |
