A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to venue for civil actions. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 15.002(a), Civil Practice and Remedies |
|
Code, is amended to read as follows: |
|
(a) Except as otherwise provided by this subchapter or |
|
Subchapter B or C, all lawsuits shall be brought: |
|
(1) in the county in which all or a substantial part of |
|
the events or omissions giving rise to the claim occurred; |
|
(2) in the county of defendant's residence at the time |
|
the cause of action accrued if defendant is a natural person; |
|
(3) in the county of the defendant's principal office |
|
in this state, if the defendant is not a natural person; or |
|
(4) [if Subdivisions (1), (2), and (3) do not apply,] |
|
in the county in which the plaintiff resided at the time of the |
|
accrual of the cause of action. |
|
SECTION 2. Sections 15.002(b) and (c), Civil Practice and |
|
Remedies Code, are repealed. |
|
SECTION 3. The change in law made by this Act applies only |
|
to an action commenced on or after the effective date of this Act. |
|
An action that is commenced before the effective date of this Act is |
|
governed by the law in effect at the time the cause of action |
|
accrued, and that law is continued in effect for that purpose. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
