A BILL TO BE ENTITLED
AN ACT
relating to a study of state statutes, rules, and policies
regarding special education.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 29, Education Code, is
amended by adding Section 29.0021 to read as follows:
       Sec. 29.0021.  STUDY OF STATE LAWS AND POLICIES RELATED TO
SPECIAL EDUCATION.  (a)  The agency shall establish a committee
composed of teachers, school administrators, parents, and other
interested persons to study the state statutes, rules adopted under
those statutes, and any related policies involved in the statewide
design for delivery of services to children with disabilities in
this state.
       (b)  In studying the statutes, rules, and policies, the
committee shall:
             (1)  determine whether a statute, rule, or policy is
required under federal law;
             (2)  determine the method or means to eliminate any
statute, rule, or policy identified under Subdivision (1); and
             (3)  consider the fiscal impact to the state in
maintaining any statute, rule, or policy identified under
Subdivision (1).
       (c)  Not later than July 1, 2008, the committee shall
recommend to the legislature and the commissioner any necessary
changes to any statute, rule, or policy identified under Subsection
(b)(1).
       (d)  This section expires August 1, 2008.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
