A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a study of state statutes, rules, and policies |
|
regarding special education. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 29, Education Code, is |
|
amended by adding Section 29.0021 to read as follows: |
|
Sec. 29.0021. STUDY OF STATE LAWS AND POLICIES RELATED TO |
|
SPECIAL EDUCATION. (a) The agency shall establish a committee |
|
composed of teachers, school administrators, parents, and other |
|
interested persons to study the state statutes, rules adopted under |
|
those statutes, and any related policies involved in the statewide |
|
design for delivery of services to children with disabilities in |
|
this state. |
|
(b) In studying the statutes, rules, and policies, the |
|
committee shall: |
|
(1) determine whether a statute, rule, or policy is |
|
required under federal law; |
|
(2) determine the method or means to eliminate any |
|
statute, rule, or policy identified under Subdivision (1); and |
|
(3) consider the fiscal impact to the state in |
|
maintaining any statute, rule, or policy identified under |
|
Subdivision (1). |
|
(c) Not later than July 1, 2008, the committee shall |
|
recommend to the legislature and the commissioner any necessary |
|
changes to any statute, rule, or policy identified under Subsection |
|
(b)(1). |
|
(d) This section expires August 1, 2008. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
