A BILL TO BE ENTITLED
AN ACT
relating to the applicability of certain law to contraception.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 170, Health and Safety Code, is amended
by adding Section 170.006 to read as follows:
       Sec. 170.006.  CONTRACEPTION.  (a)  In this section,
"contraception" means any method of preventing pregnancy that is
approved by the United States Food and Drug Administration.
       (b)  This chapter does not apply to contraception.
       SECTION 2.  Subchapter A, Chapter 171, Health and Safety
Code, is amended by adding Section 171.006 to read as follows:
       Sec. 171.006.  CONTRACEPTION.  (a)  In this section,
"contraception" means any method of preventing pregnancy that is
approved by the United States Food and Drug Administration.
       (b)  This chapter does not apply to contraception.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
