A BILL TO BE ENTITLED
AN ACT
relating to the authority of certain counties to select the
lowest-cost provider of water supply and sewer services.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter B, Chapter 412, Local Government
Code, is amended by adding Section 412.017 to read as follows:
       Sec. 412.017.  COUNTY CHOICE OF WATER SUPPLY AND SEWER
SERVICE UTILITY.  (a)  This section applies only to a county
contracting for water supply and sewer services for a county-owned
building that is located:
             (1)  within the service area of a water supply
corporation that has, for that area, a certificate of convenience
and necessity issued by the Texas Commission on Environmental
Quality; and
             (2)  within the boundaries of a municipality that
provides water supply and sewer services to its service areas under
the municipality's certificates of convenience and necessity
issued by the Texas Commission on Environmental Quality.
       (b)  The commissioners court of the county may determine
whether the water supply corporation or the municipality can
reliably provide water supply and sewer services to the county
building at the lowest cost to the county.  The commissioners court
may contract with the lowest-cost provider to provide those
services to the building.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
