A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of certain counties to select the |
|
lowest-cost provider of water supply and sewer services. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 412, Local Government |
|
Code, is amended by adding Section 412.017 to read as follows: |
|
Sec. 412.017. COUNTY CHOICE OF WATER SUPPLY AND SEWER |
|
SERVICE UTILITY. (a) This section applies only to a county |
|
contracting for water supply and sewer services for a county-owned |
|
building that is located: |
|
(1) within the service area of a water supply |
|
corporation that has, for that area, a certificate of convenience |
|
and necessity issued by the Texas Commission on Environmental |
|
Quality; and |
|
(2) within the boundaries of a municipality that |
|
provides water supply and sewer services to its service areas under |
|
the municipality's certificates of convenience and necessity |
|
issued by the Texas Commission on Environmental Quality. |
|
(b) The commissioners court of the county may determine |
|
whether the water supply corporation or the municipality can |
|
reliably provide water supply and sewer services to the county |
|
building at the lowest cost to the county. The commissioners court |
|
may contract with the lowest-cost provider to provide those |
|
services to the building. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
