A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the compliance review and safety audit program for |
|
|
commercial motor vehicles. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 644.155, Transportation Code, is amended |
|
|
to read as follows: |
|
|
Sec. 644.155. COMPLIANCE REVIEW AND SAFETY AUDIT PROGRAM. |
|
|
(a) The department shall implement and enforce a compliance review |
|
|
and safety audit program similar to the federal program established |
|
|
under 49 C.F.R. Part 385 for any person who owns or operates a |
|
|
commercial motor vehicle that is domiciled in this state. |
|
|
(b) As part of the program implemented under Subsection (a), |
|
|
the department shall require a compliance review and safety audit |
|
|
of a motor carrier that exceeds the accident factor, as described by |
|
|
49 C.F.R. Part 385, Appendix A to Part 385. |
|
|
SECTION 2. The changes in law made by this Act to Section |
|
|
644.155, Transportation Code, apply only to a commercial motor |
|
|
vehicle accident that occurs on or after the effective date of this |
|
|
Act. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
