A BILL TO BE ENTITLED
AN ACT
relating to exemptions from certain statutory requirements for
certain school districts.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter C, Chapter 7, Education Code, is
amended by adding Section 7.0565 to read as follows:
       Sec. 7.0565.  WAIVERS AND EXEMPTIONS REQUIRED. (a)
Notwithstanding Section 7.056(e), an independent school district
that holds its election for trustees on the same date as the general
election for state and county officers is exempt from complying
with a requirement relating to:
             (1)  elementary school class size as provided by
Section 25.112, subject to Subsection (b);
             (2)  the first day of instruction as provided by
Section 25.0811;
             (3)  the assessment process and professional growth
activities for principals as provided by Section 21.054(b);
             (4)  annual field testing of questions for assessment
instruments administered under Subchapter B, Chapter 39, subject to
Subsection (c); and
             (5)  the size of:
                   (A)  a library as adopted under Section 33.021 or
other law; or
                   (B)  a computer lab.
       (b)  A school district to which this section applies must
comply with the elementary school class size requirements of
Section 25.112 as determined on a campus-based or district-based
average of students per class.
       (c)  A school district to which this section applies must
comply once every three years with the requirements relating to
field testing of questions for assessment instruments administered
under Subchapter B, Chapter 39.
       SECTION 2.  This Act applies beginning with the 2007-2008
school year.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
