A BILL TO BE ENTITLED
AN ACT
relating to providing that dedicated revenues received from
specialty license plate fees may not be used for general
governmental purposes.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter F, Chapter 403, Government Code, is
amended by adding Section 403.0951 to read as follows:
       Sec. 403.0951.  USE OF DEDICATED SPECIALTY LICENSE PLATE
REVENUE. (a) This section applies only to revenues received from
fees for the issuance of specialty license plates that wholly or
partly are dedicated by statute for a particular purpose, including
revenues received from fees for the issuance of:
             (1)  Texas Agricultural Products license plates under
Section 46.008, Agriculture Code, and Section 504.625,
Transportation Code;
             (2)  Texas YMCA license plates under Section 7.025,
Education Code, and Section 504.623, Transportation Code;
             (3)  Texas Music license plates under Section 7.027,
Education Code, and Section 504.639, Transportation Code;
             (4)  Texas Reads license plates under Section 441.0092,
Government Code, and Section 504.616, Transportation Code;
             (5)  Texas Commission on the Arts license plates under
Section 444.027, Government Code, and Section 504.604,
Transportation Code;
             (6)  Texans Conquer Cancer license plates under Section
102.017, Health and Safety Code, and Section 504.620,
Transportation Code;
             (7)  Be a Blood Donor license plates under Section
162.016, Health and Safety Code, and Section 504.641,
Transportation Code;
             (8)  Special Olympics Texas license plates under
Section 533.018, Health and Safety Code, and Section 504.621,
Transportation Code;
             (9)  Animal Friendly license plates under Section
828.014, Health and Safety Code, and Section 504.605,
Transportation Code;
             (10)  Conservation license plates under Section
11.043, Parks and Wildlife Code, and Section 504.618,
Transportation Code;
             (11)  Texas Aerospace and Aviation license plates under
Section 502.271, Transportation Code;
             (12)  Big Bend National Park license plates under
Section 504.606, Transportation Code;
             (13)  Read to Succeed license plates under Section

             (14)  Volunteer Advocate Program license plates under

             (17)  Texas. It's Like a Whole Other Country license

             (18)  Texas Commission for the Deaf and Hard of Hearing

             (20)  Texas Citrus Industry license plates under

             (21)  Waterfowl and Wetland Conservation license

             (23)  Texas State Rifle Association license plates
under Section 504.631, Transportation Code;
             (24)  Urban Forestry license plates under Section
504.632, Transportation Code;
             (25)  Share the Road license plates under Section
504.633, Transportation Code;
             (26)  El Paso Mission Valley license plates under
Section 504.635, Transportation Code;
             (27)  Cotton Boll license plates under Section 504.636,
Transportation Code;
             (28)  Daughters of the Republic of Texas license plates
under Section 504.637, Transportation Code;
             (29)  Knights of Columbus license plates under Section
504.638, Transportation Code;
             (30)  Marine Mammal Recovery license plates under
Section 504.644, Transportation Code;
             (31)  4-H license plates under Section 504.645,
Transportation Code;
             (32)  March of Dimes license plates under Section
504.651, Transportation Code;
             (33)  Master Gardener license plates under Section
504.652, Transportation Code;
             (34)  Boy Scout license plates under Section 504.6545,
Transportation Code;
             (35)  Texas Lions Camp license plates under Section
504.656, Transportation Code; and
             (36)  any other specialty license plates, provided that
revenues received from fees for the issuance of the specialty
license plates are dedicated by statute wholly or partly for a
particular purpose.
       (b)  Section 403.095 and Subchapter D, Chapter 316, do not
apply to revenues received from fees for the issuance of specialty
license plates that wholly or partly are dedicated by statute for a
particular purpose or entity.  To the extent revenue received from
fees for the issuance of a specialty license plate is dedicated by a
statute for a particular purpose or entity, the revenue is
available only for that purpose or entity.
       SECTION 2.  This Act takes effect September 1, 2007.
