A BILL TO BE ENTITLED

AN ACT
|
|
relating to verification of information disseminated by state |
|
agencies. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 2052, Government Code, is amended by |
|
adding Subchapter E to read as follows: |
|
SUBCHAPTER E. VERIFICATION OF CERTAIN INFORMATION |
|
Sec. 2052.351. VERIFICATION OF DISSEMINATED INFORMATION. A |
|
state agency may not disseminate information, including a judgment, |
|
policy statement, or review, related to a profession, product, or |
|
service regulated by the agency unless the agency verifies the |
|
accuracy of the information by consulting experts or professional |
|
or trade associations affiliated with the industry affected by the |
|
information. |
|
Sec. 2052.352. COMPLAINTS. (a) A person who believes a |
|
state agency has disseminated inaccurate, incorrect, or misleading |
|
information subject to Section 2052.351 may file a complaint with |
|
the state agency. |
|
(b) A state agency shall maintain a system to promptly and |
|
efficiently act on complaints filed with the agency under |
|
Subsection (a). The agency shall maintain information about: |
|
(1) the parties to the complaint; |
|
(2) the subject matter of the complaint; |
|
(3) a summary of the results of the review or |
|
investigation of the complaint; and |
|
(4) the disposition of the complaint. |
|
Sec. 2052.353. REPORT TO LEGISLATURE. Each state agency |
|
shall file an annual report with the legislature concerning the |
|
complaints received by the agency under Section 2052.352. |
|
SECTION 2. This Act takes effect September 1, 2007. |
