A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the approval of relative caregivers by the Department |
|
|
of Family and Protective Services as foster homes. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 264, Family Code, is |
|
|
amended by adding Section 264.7551 to read as follows: |
|
|
Sec. 264.7551. EXPEDITED APPROVAL AS FOSTER HOME OR AGENCY |
|
|
FOSTER HOME. (a) To facilitate the receipt of foster care payments, |
|
|
the department shall expedite the licensing or certification of a |
|
|
relative caregiver as a foster home or agency foster home under |
|
|
Chapter 42, Human Resources Code. |
|
|
(b) The licensing or certification process for a relative |
|
|
caregiver may not be as stringent as the routine process for other |
|
|
foster homes and agency foster homes. The department by rule may |
|
|
provide for a waiver of licensing or certification requirements for |
|
|
a relative caregiver. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
