A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the expunction of certain alcohol-related offenses |
|
|
committed by a minor. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 106.12, Alcoholic Beverage Code, is |
|
|
amended by adding Subsection (a-1) to read as follows: |
|
|
(a-1) A person convicted of not more than one violation of |
|
|
this code who has not attained the age of 21 years may apply to the |
|
|
court in which the person was convicted to have the conviction |
|
|
expunged under this section, but the court may expunge the |
|
|
conviction only on a showing by the person of good cause to expunge |
|
|
the conviction before the person attains the age of 21 years. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
