A BILL TO BE ENTITLED
AN ACT
relating to the penalty for failing to carry a driver's license
while operating a motor vehicle.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 521.025(c), Transportation Code, is
amended to read as follows:
       (c)  A person who violates this section commits an offense.
An offense under this subsection is a misdemeanor punishable by [a
fine not to exceed $200, except that]:
             (1)  [for a second conviction within one year after the
date of the first conviction, the offense is a misdemeanor
punishable by a fine of not less than $25 or more than $200; and
             [(2)  for a third or subsequent conviction within one
year after the date of the second conviction the offense is a
misdemeanor punishable by:
                   [(A)]  a fine of not less than $100 [$25] or more
than $500;
             (2) [(B)]  confinement in the county jail for not less
than 72 hours or more than six months; or
             (3) [(C)]  both the fine and confinement.
       SECTION 2.  (a) The change in law made by this Act applies
only to the punishment for an offense committed on or after
September 1, 2007. For purposes of this section, an offense is
committed before September 1, 2007, if any element of the offense
occurs before September 1, 2007.
       (b)  An offense committed before September 1, 2007, is
governed by the law in effect on the date that the offense was
committed, and the former law is continued in effect for that
purpose.
       SECTION 3.  This Act takes effect September 1, 2007.
