A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the penalty for failing to carry a driver's license |
|
|
while operating a motor vehicle. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 521.025(c), Transportation Code, is |
|
|
amended to read as follows: |
|
|
(c) A person who violates this section commits an offense. |
|
|
An offense under this subsection is a misdemeanor punishable by [a
|
|
|
fine not to exceed $200, except that]: |
|
|
(1) [for a second conviction within one year after the
|
|
|
date of the first conviction, the offense is a misdemeanor
|
|
|
punishable by a fine of not less than $25 or more than $200; and
|
|
|
[(2) for a third or subsequent conviction within one
|
|
|
year after the date of the second conviction the offense is a
|
|
|
misdemeanor punishable by:
|
|
|
[(A)] a fine of not less than $100 [$25] or more |
|
|
than $500; |
|
|
(2) [(B)] confinement in the county jail for not less |
|
|
than 72 hours or more than six months; or |
|
|
(3) [(C)] both the fine and confinement. |
|
|
SECTION 2. (a) The change in law made by this Act applies |
|
|
only to the punishment for an offense committed on or after |
|
|
September 1, 2007. For purposes of this section, an offense is |
|
|
committed before September 1, 2007, if any element of the offense |
|
|
occurs before September 1, 2007. |
|
|
(b) An offense committed before September 1, 2007, is |
|
|
governed by the law in effect on the date that the offense was |
|
|
committed, and the former law is continued in effect for that |
|
|
purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
