A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the fee for impoundment of a motor vehicle impounded for |
|
|
a second or subsequent conviction of failure to maintain evidence |
|
|
of financial responsibility for the vehicle. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 601.263, Transportation Code, is amended |
|
|
to read as follows: |
|
|
Sec. 601.263. COST FOR IMPOUNDMENT. (a) Except as provided |
|
|
by Subsection (b), the [The] court shall impose against the |
|
|
defendant a cost of $15 a day for each day of impoundment of the |
|
|
defendant's vehicle. |
|
|
(b) If the defendant applies to the court, not later than 72 |
|
|
hours after the vehicle was impounded, and provides evidence of |
|
|
financial responsibility as required for the release of the vehicle |
|
|
under Section 601.262(b), the court shall order the release of the |
|
|
vehicle and waive the fee under this section. |
|
|
SECTION 2. This Act takes effect September 1, 2007. |
