A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the ad valorem tax appraisal of certain real property on |
|
|
which action is taken to conserve groundwater. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 23, Tax Code, is amended by |
|
|
adding Section 23.145 to read as follows: |
|
|
Sec. 23.145. APPRAISAL OF PROPERTY ON WHICH ACTION IS TAKEN |
|
|
TO CONSERVE GROUNDWATER. (a) This section applies only to real |
|
|
property located in a priority groundwater management area |
|
|
designated by the Texas Commission on Environmental Quality under |
|
|
Chapter 35, Water Code. |
|
|
(b) If the owner of real property has installed a rainwater |
|
|
catchment system, implemented a brush control initiative, or taken |
|
|
other action to conserve groundwater, the present value of the |
|
|
estimated cost to the owner of the property of taking the action is |
|
|
an appropriate element that reduces the market value of the |
|
|
property and shall be taken into consideration by the chief |
|
|
appraiser in determining the market value of the property. |
|
|
SECTION 2. This Act applies only to the appraisal of real |
|
|
property for ad valorem tax purposes for a tax year beginning on or |
|
|
after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect January 1, 2008. |
