A BILL TO BE ENTITLED
AN ACT
relating to the ad valorem tax appraisal of certain real property on
which action is taken to conserve groundwater.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter B, Chapter 23, Tax Code, is amended by
adding Section 23.145 to read as follows:
       Sec. 23.145.  APPRAISAL OF PROPERTY ON WHICH ACTION IS TAKEN
TO CONSERVE GROUNDWATER. (a) This section applies only to real
property located in a priority groundwater management area
designated by the Texas Commission on Environmental Quality under
Chapter 35, Water Code.
       (b)  If the owner of real property has installed a rainwater
catchment system, implemented a brush control initiative, or taken
other action to conserve groundwater, the present value of the
estimated cost to the owner of the property of taking the action is
an appropriate element that reduces the market value of the
property and shall be taken into consideration by the chief
appraiser in determining the market value of the property.
       SECTION 2.  This Act applies only to the appraisal of real
property for ad valorem tax purposes for a tax year beginning on or
after the effective date of this Act.
       SECTION 3.  This Act takes effect January 1, 2008.
