A BILL TO BE ENTITLED
AN ACT
relating to required training for package store employees;
providing an administrative penalty.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 22, Alcoholic Beverage Code, is amended
by adding Sections 22.17 and 22.18 to read as follows:
       Sec. 22.17.  EMPLOYEE TRAINING. Each employee of a package
store permittee shall successfully complete a seller training
program every two years.  The program must be approved by the
commission and provide  information about:
             (1)  laws and commission rules applying to package
store permittees or their employees;
             (2)  best practices for a package store permittee to
follow in conducting business;  and
             (3)  other information considered appropriate by the
commission.
       Sec. 22.18.  ADMINISTRATIVE PENALTY. (a) This section
applies only to a package store permittee whose employees have not
completed the training required by Section 22.17.
       (b)  In addition to any other applicable civil or criminal
penalty or disciplinary action taken by the commission, the
commission may impose an administrative penalty on a package store
permittee who violates Section 106.03. The amount of the penalty
may not exceed $1,000 for the first violation and $1,800 for each
subsequent violation during an 18-month period.
       SECTION 2.  This Act takes effect March 1, 2008.
