A BILL TO BE ENTITLED
AN ACT
relating to the identification of certain practitioners of the
healing arts; providing civil and criminal penalties.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Title 3, Subtitle A, chapter 104, Occupations
Code, is amended by adding Section 104.0031 to read as follows:
       Sec. 104.0031.  REQUIRED DISCLOSURE IN HEALTH CARE FACILITY.  
(a)  For the purposes of this section, "licensed health care
facility" means a licensed hospital, ambulatory surgical center,
nursing home or long term care facility.
       (b)  A person, other than a physician licensed under Subtitle
B of this title, who is subject to sections 104.003 or 104.004 of
this chapter, and who uses the title doctor singly or in combination
with other words shall identify through written notice, which may
include the wearing of a name tag, or orally to a patient to whom the
person is providing professional services in a licensed health care
facility the type of license, permit, registration or certificate
under which the person is practicing.
       (c)(1)  Each board or agency that licenses, permits,
registers or certifies a person subject to this section shall adopt
rules to enforce this section.
             (2)  In addition to the penalties provided by this
chapter or any other law or rule, a violation of this section or a
rule adopted under the authority of this section is subject to
action by the appropriate board or agency as a ground for revocation
or denial of a license, permit, registration or certification.
       (d)  Each licensed health care facility in this state shall
adopt policies and procedures to implement and enforce the
provisions of this section.
       SECTION 2.  Each board or agency required to adopt rules
under this Act shall adopt said rules by January 31st, 2008.
       SECTION 3.  This Act takes effect September 1, 2007.
