A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to equal representation for each political party among the |
|
|
election officers for early voting. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 85.002, Election Code, is amended by |
|
|
adding Subsection (e) to read as follows: |
|
|
(e) For the general election for state and county officers |
|
|
or a primary election conducted by a county, the composition of the |
|
|
set of election officers serving the main early voting polling |
|
|
place, including employees of the county, must provide equal |
|
|
representation for each political party holding a primary election |
|
|
in the county. |
|
|
SECTION 2. Sections 85.069(b) and (c), Election Code, are |
|
|
amended to read as follows: |
|
|
(b) The [Except as provided by Subsection (c), the] |
|
|
composition of the set of election officers serving a branch |
|
|
polling place must provide representation for each political party |
|
|
conducting a primary election in the county. |
|
|
(c) For the general election for state and county officers, |
|
|
[and for] a special election to fill a vacancy in an office |
|
|
regularly filled at the general election for state and county |
|
|
officers, and a primary election conducted by a county, the |
|
|
composition of the set of election officers serving a branch |
|
|
polling place, including [who are not] employees of the county, |
|
|
must[, to the extent practicable,] provide equal representation for |
|
|
each political party holding [conducting] a primary election in the |
|
|
county. |

|
SECTION 3. The changes in law made by this Act apply only to |
|
|
an election for which early voting begins on or after September 1, |
|
|
2007. |
|
|
SECTION 4. This Act takes effect September 1, 2007. |
