A BILL TO BE ENTITLED
AN ACT
Relating to the sale of alcoholic beverages in the jurisdiction of
certain municipalities.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS
       SECTION 1.  Add new subsections (d) and (e), to Section
251.80, Alcoholic Beverage Code, to read as follows:
       (d)  This subsection applies only to a territory that would
otherwise be subject to Subsection (a) of this Section and is
located in a city or town:
             (1)  with a population of at least 500,000; and
             (2)  is located in a county that has:
                   (A)  a population of 1.4 million or more; and
                   (B)  there are two or more cities or towns in the
county that:
                         (i)  are predominately located in the
county; and
                         (ii)  have a population of more than
300,000.
       (e)  The governing body of a city or town described by
Subsection (d) may define the boundaries of the original precinct
for purposes of a local option election. A local option election may
be held in a territory that is defined in accordance with this
Subsection. The city or town shall pay the local option election
expenses held in a territory that is defined in accordance with this
Subsection.
       SECTION 2.  This Act takes effect September 1, 2007.
