A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to requirements for joint elections for trustees of an |
|
|
independent school district. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 11.0581, Education Code, is amended by |
|
|
amending Subsection (a) and adding Subsections (a-1) and (a-2) to |
|
|
read as follows: |
|
|
(a) If more than 50 percent of the population of an |
|
|
independent school district resides in the corporate boundaries of |
|
|
a municipality, an [An] election for trustees of the [an
|
|
|
independent school] district shall be held on the same date as: |
|
|
(1) the election for the members of the governing body |
|
|
of the [a] municipality [located in the school district]; or |
|
|
(2) the general election for state and county |
|
|
officers. |
|
|
(a-1) Except as provided by Subsection (a-2), an election |
|
|
for trustees of an independent school district that is not subject |
|
|
to Subsection (a) shall be held on the same date as the general |
|
|
election for state and county officers. |
|
|
(a-2) If the territory of an independent school district is |
|
|
located in more than one municipality and no municipality contains |
|
|
a majority of the population of the district, an election for the |
|
|
trustees of the district may be held on the same date as the |
|
|
election for the members of the governing body of any municipality |
|
|
located in the district. |
|
|
SECTION 2. This Act takes effect September 1, 2007. |
