A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to medically accurate information in the provision of |
|
instruction or the development of material relating to human |
|
development and human sexuality. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 163, Health and Safety Code, is amended |
|
by adding Section 163.003 to read as follows: |
|
Sec. 163.003. MEDICALLY ACCURATE INFORMATION REQUIRED. (a) |
|
In this section, "medically accurate" means information supported |
|
by the weight of peer-reviewed research conducted in compliance |
|
with accepted scientific methods and recognized as accurate and |
|
objective by leading professional organizations and agencies with |
|
relevant expertise in the field. |
|
(b) A person who receives funding or other assistance from a |
|
department, agency, or political subdivision of this state to |
|
provide instruction or develop material for instruction regarding |
|
human development or human sexuality shall provide medically |
|
accurate information. Human development or human sexuality |
|
instruction includes: |
|
(1) sex education; |
|
(2) family life education; |
|
(3) abstinence-only education; |
|
(4) health education; and |
|
(5) character education. |
|
(c) A department, agency, or political subdivision of this |
|
state may not provide funding or other assistance for instruction |
|
or materials for instruction regarding human development or human |
|
sexuality unless the entity obtains assurance that the person |
|
providing the instruction or developing the material will provide |
|
or include only medically accurate information. |
|
(d) A person who receives funding or other assistance under |
|
Subsection (c) shall lose that funding immediately if the person |
|
provides or includes information under this section that is not |
|
medically accurate. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
