A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a teacher's authority regarding use of classroom time |
|
for preparation for the administration of certain assessment |
|
instruments. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 39, Education Code, is |
|
amended by adding Section 39.035 to read as follows: |
|
Sec. 39.035. CLASSROOM PREPARATION FOR CERTAIN ASSESSMENT |
|
INSTRUMENTS. (a) A teacher who teaches a grade level and subject |
|
for which an assessment instrument is administered under Section |
|
39.023 may determine, in connection with preparing students for the |
|
administration of the assessment instrument: |
|
(1) whether any class time will be devoted to |
|
assessment instrument preparation; and |
|
(2) the amount and scheduling of class time devoted to |
|
assessment instrument preparation. |
|
(b) A teacher's determination under Subsection (a) may be |
|
overruled only by unanimous agreement of a committee established |
|
under Subsection (c). |
|
(c) Each school district shall establish a three-member |
|
review committee to determine, on request of the principal, whether |
|
a teacher's determination under Subsection (a) is unreasonable. |
|
Members shall be appointed as follows: |
|
(1) the campus faculty shall choose two teachers to |
|
serve as members and one teacher to serve as an alternate member; |
|
and |
|
(2) the principal shall choose one member from the |
|
professional staff of the campus. |
|
SECTION 2. This Act applies beginning with the 2007-2008 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
